Terms of Service
1. About these terms
These terms are an agreement between you and Kayts ("we", reachable at support@kayts.ai) about using the Kayts website and chat (the "service"). These terms apply to you once you create an account, or when you send a message in the chat without one. How we handle personal data is described in the Privacy Policy. If you use Kayts as a consumer, nothing in these terms limits the rights that consumer law gives you. These terms and the Privacy Policy are also available in Polish, as PDF files linked at the top of each page. Both language versions are equally binding; if they differ, the one more favourable to you applies.
2. Who can use Kayts
- You must be at least 13 years old. To use the chat without an account you must be at least 16.
- If you are under 16, a parent or guardian must agree to these terms on your behalf. Until we can collect that consent, accounts for users under 16 cannot be created.
- If you are under 18, a parent or guardian must agree to any purchase of a paid plan.
- You must give a true date of birth. We may close accounts where it is clearly false.
3. Your account
You sign in with Google or with a link sent to your email address. Sign-in with Apple, Microsoft and ORCID is coming. Keep access to that email or account safe: whoever controls it can use your Kayts account. Tell us at support@kayts.ai if you think someone else has used it. We never ask for your sign-in link or code by email, message or phone, so be careful with messages that only look as if they came from Kayts. You can delete your account at any time.
You can also try the chat without an account: a few text messages to Kayts Mihr, after which you need a free account to continue. What you send without an account is not saved to any account, so you can't get it back later.
4. What Kayts is, and its limits
- Kayts is an AI assistant. Its answers are generated automatically by language models and can be wrong, incomplete or out of date, even when they sound confident.
- Answers are not professional advice: not legal, medical, financial, tax or psychological advice. Check anything important with a qualified person or a reliable source.
- In Research, Kayts answers from the papers and files you add, and can still misread or misquote them. Check the sources it cites.
- Kayts Voice Mode reads answers aloud with voices generated by AI. They are not a person speaking to you, and what they say can be as wrong as a written answer. Each plan includes a share of the natural voices; once it is used up, your browser's own voice reads the answers until it renews.
- Pictures. Kayts can create pictures and change pictures you add, with image models of other providers (today FLUX by Black Forest Labs, through OpenRouter; the Privacy Policy lists the providers). Pictures are made by AI: they can be inaccurate or come out differently than you asked, they are marked as made by AI in the chat and in the file, and they are not a record of anything that really happened. Paid plans include a number of pictures a day and a week; Free includes none.
- You decide how you use the answers, and you are responsible for that use.
- What you need. An internet connection and a current version of Chrome, Edge, Firefox or Safari with JavaScript on. Kayts keeps your session and a few settings in your browser's storage. Voice typing and Kayts Voice Mode also need a microphone and a browser with built-in speech recognition, such as Chrome or Edge (not Firefox).
5. What you may not do
You may not use Kayts to:
- break the law, or help someone else break it,
- create content that sexualises minors, promotes terrorism, or harasses, threatens or defames people,
- get help building weapons that can cause mass harm, or malware,
- violate other people's privacy or intellectual property, including by uploading files you have no right to share,
- attack, overload or test the security of the service without our written permission, or get around plan limits, including by creating more than one account (one person, one account),
- collect answers automatically to build a competing model, or resell access without our agreement,
- pretend that AI-generated content, written or spoken, comes from a person where that would mislead others,
- create or change pictures of real people to be sexual, nude, revealing, degrading or violent, or create anything sexual involving minors, even as a joke,
- make fakes meant to deceive, such as pictures of events that didn't happen, or of real people, including public figures, saying or doing things they didn't,
- add photos of other people without their consent, or photos you have no right to use.
6. Your content
- What you write and upload stays yours. The answers Kayts writes for you are yours to use, as far as the law allows.
- You give us permission to store and process your content in order to run the service for you.
- If "Help improve Kayts" is on, your conversations may also be used to fine-tune future Kayts models, in a later stage of development, as explained in the Privacy Policy (section 4). We are not training on conversations yet. For adults it is on by default; you can switch it off anytime in Settings → Privacy.
- Similar questions can get similar answers, so others may receive answers like yours.
- Pictures you add. When you add a picture and ask Kayts to change it, you confirm that you made it or have the right to use it, and that every person who can be recognised in it has agreed to it being changed in this way (for a child, a parent or guardian). You agree that we process the picture to do what you ask: it is sent to the image model through OpenRouter, and the result is kept with your account until you delete the conversation or the account.
- Pictures you make. You are responsible for how you use and share pictures made with Kayts. Don't pass them off as real photos where that would mislead others, and respect the people shown in them: their image, their dignity and their privacy.
7. Plans and payments
- Plans. Kayts has a free plan, Free, and three paid plans: Plus ($5.99 a month), Pro ($12.99) and Max ($19.99); each can also be paid for a year at once, at twelve times the monthly price. Each plan includes everything in the cheaper ones; the pricing page shows what each one adds. Every plan has daily and weekly usage limits, including for Kayts Voice Mode and Audio, and the chat shows how much of them is left.
- Prices. Prices are in US dollars and include VAT or sales tax. At checkout the price may be shown in your own currency; the amount shown there is what you pay.
- Who sells the plans. Paid plans are sold through Link (Link, LLC, USA), Stripe's checkout service, which acts as reseller and merchant of record: it takes the payment, issues the invoice and handles the tax. Your receipt says "Sold through Link" and your bank statement shows LINK.COM. Link's own terms also apply to the payment. Kayts provides the service itself, and these terms govern how you use it.
- Billing and renewal. A paid plan is billed in advance, monthly or yearly as you choose when you buy it, starting on the day you buy it, and renews automatically for the same period until you cancel it. You get a receipt by email for each payment.
- Free days on Plus. Until 31 December 2026, a Plus plan bought by an account that has never had a paid plan starts with 14 days free. You give your payment details when you buy it. If you cancel during those 14 days, you pay nothing and the plan ends when they do; otherwise the first payment is taken when they end. Each account gets the free days once.
- Cancelling. You can cancel at any time in Settings → Billing, or in your Link account. Your plan stays until the end of the month or year you have paid for; then your account moves to Free and you are not charged again.
- Changing plans. A move to a higher plan starts at once, and you pay the difference for the rest of the current period. A move to a lower plan starts at your next renewal; until then you keep the plan you have. The same holds for the billing period: moving from monthly to yearly starts at once, from yearly to monthly at your next renewal.
- Failed payments. If a renewal payment fails, Stripe tries again for a short time. If it still fails, the plan ends and your account moves to Free.
- Your right to withdraw. If you are a consumer, you can withdraw from a paid plan within 14 days of buying it, without giving a reason, by writing to support@kayts.ai or through Link support. A short message saying that you withdraw is enough; you may also use the model form below. We refund the full price of that purchase within 14 days of your message, to the way you paid.
- Deleting your account. If you delete your account while a paid plan is running, the plan ends at once and you are not charged again. Write to support@kayts.ai within 60 days, from the email address of that account, and we refund the unused part of the month or year you paid for.
- Price changes. We may change the price of a plan when our costs change, for example the price of the models and services Kayts runs on, or taxes. We tell you by email at least 30 days before a new price applies to you; it applies from your first renewal after that. If you don't accept it, cancel before then and you won't pay the new price.
- If a paid plan doesn't work as described, tell us at support@kayts.ai. We put it right within a reasonable time. If we can't, or the problem is serious, you can have the price reduced or end the plan with a refund for the time it didn't work, as consumer law provides (in Poland, article 43h and following of the Consumer Rights Act).
Model withdrawal form (fill it in and send it only if you want to withdraw):
To Kayts, support@kayts.ai:
I hereby withdraw from my contract for the following service: Kayts plan ________, bought on ________.
Name: ________ · Email address of the Kayts account: ________ · Date: ________
8. Availability and changes
We work to keep Kayts available, but it may sometimes be unavailable, for example during maintenance. Kayts is in early access, so features, models, voices and usage limits may change. We change them only for good reason: to keep the service secure and working, to follow the law or a decision of an authority, when a model or service provider we rely on changes its offer or stops, to add or improve features, or to stop abuse. A change never costs you anything extra. If it significantly reduces what your paid plan includes, we tell you by email in advance, and you may end the plan within 30 days of the change, or of our message if that comes later, with a refund of the unused part of the month.
9. Ending the agreement
You can stop using Kayts and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms. Unless the breach is serious or the law requires otherwise, we will warn you first and explain why. A picture request that breaks section 5 is not carried out and gets a warning in the chat; if it happens again, we suspend the account. Content that may be a crime, such as sexual material involving minors, we report to the authorities.
10. Liability
We are responsible for providing the service with due care. Answers and pictures are produced by AI models of other providers, without anyone checking each of them in advance. We work to keep Kayts lawful and respectful of other people, through the rules in section 5, automatic checks of picture requests, warnings and moderation (section 13). We are not responsible for decisions you make based on AI answers (section 4), for content you create in breach of these terms or how you use it, or for damage caused by breaking these terms. Nothing in these terms limits liability that cannot be limited by law, including for intentional harm or gross negligence, or your rights as a consumer.
11. Complaints and disputes
Send complaints to support@kayts.ai. We answer within 14 days. Polish law applies; if you are a consumer, you also keep the protection of the law of the country where you live. Consumers can use out-of-court dispute resolution, for example through the consumer ombudsman (rzecznik konsumentów) or the provincial trade inspectorate (Inspekcja Handlowa).
12. Changes to these terms
We may update these terms, for example when we add features or the law changes. We will tell you about important changes in Kayts or by email at least 14 days before they apply. If you don't agree, you can delete your account before then. The version and date are at the top of this page.
13. Reporting illegal content, and how we moderate
- Contact point. For users and for authorities, including under the EU Digital Services Act (articles 11 and 12): support@kayts.ai, in English or Polish.
- Reporting. If you think something on Kayts is illegal, for example a chat someone shared by link, write to support@kayts.ai with the link or where it is, why you think it is illegal, your name and email address (not needed when you report child sexual abuse material), and a statement that you believe in good faith that the report is accurate and complete. We confirm that we received it, decide carefully and without undue delay, and tell you what we decided and how to challenge it.
- How we moderate. We don't read conversations as a matter of routine. The models follow built-in safety rules, and requests for pictures are also checked automatically for sexual, revealing and degrading content: such a request is not carried out, and you see a warning. We look at a shared chat or an account when someone reports it or when we see signs of abuse, such as limits being worked around or repeated warnings. We may take a shared link down, limit features, or suspend or close an account that breaks the law or these terms (section 5). People, not only automated tools, make these decisions.
- Telling you why. If we take your content down or restrict your account, we tell you why, which rule or law it broke, and how to ask us to look at it again: reply to our message or write to support@kayts.ai, and we review the decision. You can also go to a court or an out-of-court dispute settlement body.
